ClearGate (built and operated by Agentify Technologies) provides AI-powered income verification and eligibility determination software designed specifically for property managers and affordable housing operators. Because our platform interacts with sensitive financial and personal data, we are committed to upholding the highest standards of data privacy, security, and Fair Housing compliance.

This Privacy Policy explains how we collect, use, and share information when you interact with our website, our software, or when a property manager utilizes ClearGate to screen an application.

1. Information We Collect

When you use the ClearGate platform, we collect two primary types of data:

  • Identity Data: Name, email address, phone number, and physical addresses collected either directly from property applicants or transmitted by our property management partners.
  • Financial & Bank Data: Bank account routing numbers, transaction histories, payroll deposits, and direct income sources. We utilize encrypted, third-party financial aggregators (e.g., Plaid) to establish these connections. We never see or store your raw bank login credentials.
  • Usage Data: We automatically log standard usage data, including IP addresses, browser types, interaction metadata, and cookies when you visit our landing pages or use our web application.

2. How We Use This Information

The core purpose of ClearGate is to automate eligibility logic. Your data is strictly used for the following operational workflows:

  • Income Verification: Automatically calculating average gross income based on direct-deposit transaction data to replace easily-forged paystubs.
  • Program Eligibility: Running verified income values against localized threshold criteria (e.g., HUD area median income limits, Section 8 voucher eligibility).
  • Audit Logging & Compliance: Generating immutable "Eligibility Reports" for property managers to maintain auditable compliance records for housing regulators.
  • AI Training: ClearGate leverages AI to categorize and analyze income streams. All data used for model tuning is heavily anonymized and stripped of personally identifiable information (PII).

3. How We Share Information (We Do Not Sell Your Data)

ClearGate does not, and will never, sell applicant financial data or personal information to third-party data brokers or advertisers.

Data is shared exclusively in the following limited contexts:

  • Property Managers: When you connect your bank account during an application flow, the resulting Eligibility Report and income analysis are transmitted directly and securely to the specific property management company you applied to.
  • Essential Service Providers: We employ trusted, SOC-2 compliant vendors to operate our service (e.g., AWS for secure server hosting, Plaid for secure banking API connections). These vendors are contractually prohibited from using your data for any independent purposes.
  • Legal Requirements: If required by a valid subpoena, court order, or authorized regulatory audit (e.g., a HUD investigation), we may disclose compliance records as legally mandated.

4. Fair Housing and Anti-Bias Commitment

ClearGate is engineered to be strictly compliant with the Fair Housing Act and HUD regulations. Our automated decision-making and eligibility logic engines do not collect, ingest, or process protected class data, including race, color, national origin, religion, sex/gender, familial status, or disability.

5. Data Security

We protect sensitive applicant data using enterprise-grade security protocols.

  • Encryption: All data is encrypted at rest using AES-256 and transmitted securely using TLS 1.2 or higher.
  • Access Limits: Access to applicant PII and financial records is strictly walled off internally and limited to authorized system processes.

6. Data Retention and Deletion

Because property managers are subject to state and federal record-keeping laws (such as holding application decisions for HUD audits), ClearGate retains underlying screening records and Eligibility Reports for a period of up to 7 years. Following the expiration of legally mandated retention windows, all linked financial data is securely expunged from our operational databases.

7. Your Consumer Rights (FCRA & CCPA)

Depending on where you live or the outcome of your housing application, you have specific rights regarding your data:

  • Adverse Action (FCRA): If a property manager denies your application based on a ClearGate Eligibility Report, you have the right under the Fair Credit Reporting Act to understand the data used and dispute any inaccuracies directly by contacting us or the property manager.
  • Access & Deletion: You have the right to request a copy of the data we hold about you or request its deletion (subject to the aforementioned legal retention overrides for housing compliance).
